Social Security Organization (SOCSO)

The Social Security Organization or SOCSO exists to carry out and administer the social security schemes, which is part of Employee’s Security Act 1969.

SOCSO is more popularly known with its Malay abbreviation PERKESO (which stands for Pertubuhan Keselamatan Sosial).

Under the act, Employment Injury Insurance Scheme and the Invalidity Pension Scheme are enacted as a mean to protect the welfare of the employees in case of injuries, or death arising from accidents and mishaps during work.

To achieve this, SOCSO plays a key role to register the employers (and employees), collect the SOCSO contribution (or deduction), process the benefit claims as well as make payment to the workers or their beneficiaries. SOCSO covers the Malaysian citizens and permanent residents (PRs) and not foreign workers, who are protected under the Workmen’s Compensation Act 1952. Additionally, those who work as domestic servants (e.g. maid, gardeners, watchman and drivers) are also not covered.

While the EPF (Employee Provident Fund) contribution is compulsory for all private and non-pensionable workers, SOCSO contribution is only compulsory for those earning monthly wages of RM2,000 or below. This is regardless of the employment status of the workers i.e. permanent, contract or temporary employment. And these wages will include basic salary, commission, overtime payment, leave payments and allowances (e.g. traveling, housing, shift and so on). Workers who earn more than that may also optionally choose to register with SOCSO and make deduction.

There have been cases reported of SOCSO’s failure to disburse compensation in a timely and efficient manner but the organization continues to improve its service and ensure all members can benefit from the scheme.

In June 2008, SOCSO announced a 24-hour disbursement, which means those who are eligible for SOCSO benefits can receive their disbursement within 24 hours if all the required documents were provided during their claim.

1. The Employment Act 1955 elaborates the min annual leave entitlement as follows:
- Less than 2 years of service – 8 days
- Between 2 years and 5 years – 12 days
- More than 5 years – 16 days

2. Please note maternity leave is for pregnancy and confinement (60 days subject to terms).

Leaves arising from the deaths of family members and relatives are called Compassionate Leave (1-2 days usually). This is given with the jurisdiction of the employer. Sometimes, Emergency Leave is used when there’s no compassionate leave entitlement.

Contact the nearest Socso office and explain the situation – there might be entitlement but you’d need to follow the correct processes and procedures.
